18385\/T<\/p><p>(hereinafter referred to as the &#8220;Provider&#8221;)<\/p><p>issues the following terms and conditions for providing services on the website www.kupaliskodiakovce.sk (hereinafter referred to as &#8220;Terms and Conditions&#8221;) effective from January 1, 2025:<\/p><h3 style=\"text-align: center;\">Article I&nbsp;\u2013 Introductory Provisions<\/h3><p>1. The Terms and Conditions apply to every person who enters and uses the website www.kupaliskodiakovce.sk (hereinafter referred to as the &#8220;User&#8221;).<br>2. The Terms and Conditions govern the rights and obligations of the contracting parties arising from the agreement on the provision of services on the website www.kupaliskodiakovce.sk, concluded between the Provider and the User, the subject of which is the use of services on the website www.kupaliskodiakovce.sk. If the User does not agree to comply with the Terms and Conditions, they cannot use the services on the website www.kupaliskodiakovce.sk.<br>3. The use of information, photographs, or any graphic representations on the website www.kupaliskodiakovce.sk is subject to the Terms and Conditions.<br>4. The data and information provided on the website www.kupaliskodiakovce.sk are for informational purposes and are not binding. The Provider bears no responsibility for any potential infection of the information provided on the website www.kupaliskodiakovce.sk by computer viruses.  <\/p><h3 style=\"text-align: center;\">Article II \u2013 Rights and Obligations of the User and the Provider<\/h3><p>1. The User confirms that they have read the Terms and Conditions, agree with them, and commit to comply with them.<br>2. The User is entitled to use the website www.kupaliskodiakovce.sk only for their personal needs or for the purpose of entering into a&nbsp;legal relationship with the Provider.<br>3. Texts, photographs, and other graphic elements used on the website www.kupaliskodiakovce.sk are protected by copyright and other legal regulations related to industrial property. The User may not copy, reproduce, distribute, modify, or otherwise publicly disseminate them without the prior written consent of the Provider. <br>4. The Provider undertakes to maintain confidentiality about the information and personal data obtained in this way, except in cases where it is obliged to inform third parties (especially law enforcement authorities) about such information or personal data in accordance with applicable legislation.<br>5. The User undertakes to pay the Provider the price of the ordered services in the required amount and within the required deadline.<br>6. The Provider bears no responsibility for damages arising in connection with unauthorized use or misuse of the website www.kupaliskodiakovce.sk, in connection with its malfunction, delay in transmission, computer virus attacks, or other failures.<\/p><h3 style=\"text-align: center;\">Article III \u2013 Procedure for Concluding a&nbsp;Service Agreement, Payment Terms<\/h3><p>1. If the User is interested in ordering the Provider&#8217;s services, the User shall fill out the reservation form in the reservation system. In the reservation form, the User is obliged to properly fill in all required information. The reservation and contact forms are published on the website www.kupaliskodiakovce.sk.<br>2. The User sends the order through the completed reservation form to the Provider via the Internet. The delivery of such an order to the Provider is considered a&nbsp;proposal to conclude a&nbsp;service agreement between the Provider and the User.<br>3. The Provider undertakes to provide and ensure services to the extent offered in real-time in the reservation system.<br>4. The displayed accommodation facilities and capacities are available and updated in real-time by the Provider.<br>5. During the stay, the User is entitled only to services that they properly marked and paid in full in the reservation system. If accommodation on a&nbsp;children&#8217;s extra bed is needed, it is necessary that such an additional service is specified when reserving additional services by the User.<br>6. When reserving additional services, the User is entitled only to the provision of the number of services that they properly reserved. In this case, the reservation confirmation, which the online reservation system automatically generates in step 3&nbsp;of the reservation process for both the Provider and the User, is decisive. The User has the right to additionally supplement the reservation and expand the reserved services at any time after making the reservation.<br>7. Services offered on the Provider&#8217;s website can be paid for online by credit card, bank transfer, or in cash at the Provider&#8217;s cash desk.       <\/p><p style=\"padding-left: 40px;\">a) When choosing to pay by credit\/debit card, the condition for confirming a&nbsp;binding reservation of services is the payment of a&nbsp;deposit of 100% of the price of the ordered services, which are automatically generated by the system during the reservation.<br>b) When choosing to pay by bank transfer to the Provider&#8217;s account, the condition for confirming a&nbsp;binding reservation of services is the payment of a&nbsp;deposit of 100% of the price of the ordered services, which are automatically generated by the system during the reservation. Note: The payment for this method must be credited to the Provider&#8217;s account no later than 4&nbsp;calendar days from the date of issuing the pro forma invoice, which is automatically generated by the reservation system after sending the reservation form. The payment is considered to be the moment when the funds are credited to the Provider&#8217;s account, not when the payment is sent from the User&#8217;s bank account! If the payment is not credited to the Provider&#8217;s account within 4&nbsp;calendar days, the reservation will be automatically canceled. The User will be informed about this fact by an automatic email sent by the Provider&#8217;s reservation system.<br>c) When choosing to pay in cash, it is necessary to pay 100% of the pro forma invoice amount no later than 4&nbsp;calendar days from the date of issuing the pro forma invoice automatically generated by the reservation system when sending the reservation form. If the pro forma invoice is not paid to the provider&#8217;s cash desk within 4&nbsp;calendar days, the reservation will be automatically canceled. The User will be informed about this fact by an automatic email sent by the Provider&#8217;s reservation system.      <\/p><p>8. Payment details are provided on the pro forma invoice or in the payment gateway for credit\/debit card payments.<br>9. If the User does not pay the required deposit for the stay within the specified period (within 4&nbsp;calendar days from the generation of the pro forma invoice), the online reservation of services is automatically canceled in full. The user will be informed about this fact by an automatic email sent by the Provider&#8217;s reservation system.<br>10. All payment fees are borne by the User.<br>11. After paying the pro forma invoice in full, the User will receive a&nbsp;reservation confirmation from the Provider, which will be sent to their email address. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d1771d0 elementor-widget elementor-widget-menu-anchor\" data-id=\"d1771d0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"menu-anchor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-menu-anchor\" id=\"cancellation-terms\"><\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df27cb2 color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"df27cb2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 style=\"text-align: center;\">Article IV \u2013 Cancellation of the Service Agreement, Cancellation Terms, Refund<\/h3><p>1. In case of cancellation of an already paid and thus confirmed stay and\/or ordered service by the User, the Provider is entitled to compensation in the form of a&nbsp;cancellation fee. (For this reason, we recommend that the User take out travel insurance that would cover any cancellation fees specified in these Terms and Conditions in justified cases).<br>2. In case of cancellation of an already paid stay and\/or ordered service 11 or more calendar days (inclusive) before the booked check-in date, the cancellation fee is set at 5% of the paid price of the stay. <br>In case of cancellation of the stay and\/or ordered service less than 10 calendar days (inclusive) before the booked check-in date and\/or ordered service, the cancellation fees are set as follows: <\/p><p style=\"padding-left: 40px;\">\u2022 10 to 6&nbsp;calendar days before the reserved check-in date (inclusive), a&nbsp;50% cancellation fee of the paid price of the stay is applied. <br>\u2022 5&nbsp;(inclusive) or fewer calendar days before the reserved check-in date for the stay and\/or ordered service, a&nbsp;100% cancellation fee of the paid price of the stay is applied.<\/p><p><strong>Example:<\/strong><br>The User reserves a&nbsp;stay and\/or ordered service on July 1&nbsp;with a&nbsp;check-in date and\/or service provision date of July 28. The cancellation options in this case are:  <\/p><p style=\"padding-left: 40px;\">\u2022 From July 1&nbsp;to July 17, a&nbsp;5% cancellation fee is charged;<br>\u2022 From July 18 to July 22, a&nbsp;50% cancellation fee is charged; <br>\u2022 From July 23, a&nbsp;100% cancellation fee will be charged     <\/p><p><strong>NOTICE:<\/strong><br><strong>By reserving accommodation and\/or other ordered services, the User acknowledges and agrees that in case of cancellation of such stay and\/or other ordered services, they will be charged a&nbsp;cancellation fee in accordance with this article.<\/strong> <br>3. In case of cancellation of a&nbsp;reserved stay and\/or services, the User is obliged to provide the following information in the designated online form:<\/p><p style=\"padding-left: 40px;\">\u2022 Name and surname of the person for whom the stay and\/or services were reserved (ordered);<br>\u2022 Order number stated in the received reservation confirmation;<br>\u2022 Account number in IBAN format to which the remaining amount should be returned<\/p><p style=\"text-align: center;\"><strong>Please fill out the form for refund of funds Funds<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t<\/button>\n\t\t\t\t<\/div>\n\t\t\t<\/div>\n\t\t<\/form>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f22666e color-scheme-inherit text-left elementor-widget elementor-widget-text-editor\" data-id=\"f22666e\" data-element_type=\"widget\" data-e-type=\"widget\" In case of voluntary early departure of the User from the accommodation (shortening of stay), the User is not entitled to a&nbsp;refund for unused services.<br>In case of cancellation, shortening of stay, or failure to arrive for the stay by the User due to illness, death, natural disaster, or severe accident, the User claims the charged cancellation fees through their insurance company where they have travel insurance.<\/p><p>5. In case of an exceptional, acute cancellation of the stay by the Provider, which was caused by force majeure (unforeseen circumstances that are not caused by the Provider&#8217;s activities in any way), the Provider will offer the User a&nbsp;reasonable alternative reservation at another alternative date, or in another accommodation unit that will be appropriate to the User&#8217;s originally ordered requirements. If the User does not accept the Provider&#8217;s offer, the Provider will refund the User&#8217;s paid deposit, i.e., 100% of the paid price of the stay and\/or service. <\/p><p>6. Introductory Provisions<\/h3><p>1. These terms and conditions (hereinafter referred to as &#8220;T&amp;C&#8221;) regulate, in accordance with the Civil Code, the relationship between the seller and an individual \u2013 the buyer (hereinafter referred to as &#8220;buyer&#8221;), arising from the purchase of tickets through the seller&#8217;s website, as well as those purchased through partner sales points (Ava Jett petrol stations), in those parts of the T&amp;C that objectively apply to buyers based on the method of purchase.<br>2. By purchasing a&nbsp;ticket, the buyer confirms that they have read the T&amp;C, understand their content, and fully agree to them. The T&amp;C form an integral part of the purchase agreement.<br>3. Contacting the seller means contacting the seller&#8217;s authorized person via email <a href=\"mailto:info@kupaliskodiakovce.sk\">info@kupaliskodiakovce.sk<\/a> or via the contact details provided on the website <a href=\"https:\/\/www.kupaliskodiakovce.sk\/\">www.kupaliskodiakovce.sk<\/a>. <\/p><h3 style=\"text-align: center;\">2. Definition of a&nbsp;Ticket<\/h3><p>1. <strong>A ticket<\/strong> is a&nbsp;security and simultaneously an electronic or paper document entitling its holder to a&nbsp;single entry to the specific Event for which it was purchased. The ticket is valid exclusively for the Event stated on the ticket and cannot be used for another Event or exchanged for another ticket, unless the seller explicitly states otherwise. Each ticket contains, in particular, the following information:  <\/p><ul><li>name of the Event,<\/li><li>date and time of the Event,<\/li><li>venue of the Event,<\/li><li>exact seating location (if the Event has reserved seating),<\/li><li>ticket price,<\/li><li>unique identifier (barcode or QR code),<\/li><li>ticket type (seating, standing, VIP sector, etc., or electronic ticket\/paper ticket),<\/li><li>identification of the organizer and\/or co-organizer,<\/li><li>any protective elements designed to enhance the ticket&#8217;s protection against counterfeiting and\/or alteration.<\/li><\/ul><p>2. The electronic ticket is delivered exclusively to the buyer&#8217;s email and has the same legal force as a&nbsp;paper ticket.<br>3. The buyer must protect the ticket against loss, damage, unauthorized copying, or misuse. The seller is not responsible for consequences arising from unauthorized use of the ticket.<br>4. The ticket is valid only if it is legible, undamaged, and allows for clear verification of its authenticity. If the ticket fails authenticity control upon entry to the Event due to damage or if it has already been used, the organizer is entitled to refuse entry to its holder without right to compensation.  <\/p><h3 style=\"text-align: center;\">3. Subject of the Contract<\/h3><p>1. The subject of the contract is the seller&#8217;s obligation to deliver tickets for the selected Event to the buyer and the buyer&#8217;s obligation to pay the ticket price.<br>2. The purchase contract is concluded at the moment the buyer pays the ticket price.<br>3. The seller will deliver the tickets without undue delay after the payment is credited to the seller&#8217;s account. Upon delivery of the tickets to the buyer&#8217;s email, the seller&#8217;s obligations are deemed fulfilled.<br>4. Tickets are <strong>not sent by post or cash on delivery<\/strong>. <\/p><h3 style=\"text-align: center;\">4. Rights and Obligations related to the Event<\/h3><p>1. The seller is the organizer of the Event. By purchasing a&nbsp;ticket, a&nbsp;legal relationship arises between the buyer and the seller as the organizer.<br>2. The buyer must comply with the organizer&#8217;s rules, visitor regulations, and instructions of the event staff.<br>3. The seller has the exclusive right to change the program, date, or venue of the Event. The buyer acknowledges this.<br>4. The seller is not responsible for the validity of tickets purchased outside official sales channels and\/or official sales points.  <\/p><h3 style=\"text-align: center;\">5. Payment Conditions<\/h3><p>1. The ticket price is listed separately for each Event and is final, meaning it already includes any service fees of the seller.<br>2. For online purchases, tickets can be paid for by:<br>\u2013 VISA payment card,<br>\u2013 bank transfer according to instructions after completing the order.<br>3. If payment is not received within <strong>4 (four) days<\/strong> of placing the order, the order will be automatically cancelled.<br>4. The seller is not responsible for the buyer&#8217;s costs related to payment (bank fees, card fees, etc.).<br>5. The seller is entitled to charge the buyer <strong>service fees<\/strong> associated with order processing, operation of the sales system, technical provision of ticket sales, and related administrative tasks. Service fees may be charged for each purchased ticket, and the buyer must pay them together with the ticket purchase price.<br>6. The service fee amount is always displayed to the buyer during the order creation process before confirmation. Service fees are non-refundable, even in the event of an Event cancellation, unless explicitly stated otherwise. The service fee is a&nbsp;flat rate of \u20ac0.40 \/ ticket and will be added to the ticket price.   <\/p><h3 style=\"text-align: center;\">6. Ticket Delivery<\/h3><p>1. Electronic tickets are delivered to the buyer&#8217;s email no later than <strong>24 hours<\/strong> after payment is received, and the buyer will be notified by email.<br>2. The ticket is considered delivered at the moment it is sent to the buyer&#8217;s email.<br>3. The seller is not responsible for non-delivery of the ticket due to reasons attributable to the buyer (incorrect email, full inbox, spam filter, etc.).<\/p><h3 style=\"text-align: center;\">7. Rights and Obligations of the Ticket Holder<\/h3><p>1. The ticket entitles the holder to a&nbsp;single entry to the Event. After leaving the event venue, the ticket loses its validity, unless the organizer specifies otherwise (e.g., for VIP tickets, etc.).<br>2. The buyer must check the information on the ticket immediately upon its delivery.<br>3. The seller is not responsible for the loss, theft, damage, or destruction of the ticket, or any actions by the buyer concerning the ticket, and does not provide replacement tickets.<br>4. The buyer must respect the organizer&#8217;s instructions, safety rules, and prohibitions stated directly in the Event instructions or in these T  <\/p><h3 style=\"text-align: center;\">8. Withdrawal from the Contract<\/h3><p>The buyer <strong>does not have the right to withdraw from the contract<\/strong> according to \u00a7 19, par. 1, letter l) of the Consumer Protection Act and on the amendment and supplementation of certain laws no. 108\/2024 Coll. in distance selling, as these are services related to leisure activities provided on a&nbsp;specific date, meaning these are services related to leisure activities if, according to the contract, the seller is to provide these services at a&nbsp;precisely agreed time or within a&nbsp;precisely agreed period.   <\/p><h3 style=\"text-align: center;\">9. Complaints Procedure<\/h3><p>1. Complaints are governed by these TC.<br>2. The buyer is entitled to a&nbsp;refund of the admission fee only in cases specified in this article. Service fees are non-refundable.<br>3. The buyer is not entitled to exchange a&nbsp;ticket. Damaged, lost, or invalidated tickets are not replaced.<br>4. If the buyer does not receive the ticket within 24 hours of payment being received by the seller, they must contact the seller within the next 48 hours.<br>5. In such a&nbsp;case, the seller:<br>\u2013 will resend the ticket within 24 hours,<br>\u2013 if the Event has already taken place in the meantime, will refund the paid ticket price to the buyer within 30 days.<br>6. In the event of force majeure (natural disasters, pandemic, strike, etc.), the seller reserves the right to postpone the Event to an alternative date or cancel it. If the Event is postponed to an alternative date, the ticket remains valid, and the admission fee is not refunded.<br>7. In the event of a&nbsp;complete cancellation of the Event, the seller will refund the admission fee using the same method of payment, within 30 days. Service fees are non-refundable.<br>8. The buyer submits complaints to the email: <a href=\"mailto:info@kupaliskodiakovce.sk\">info@kupaliskodiakovce.sk<\/a>.    <\/p><h3 style=\"text-align: center;\">10. Safety Rules and Conditions for Entry to the Event<\/h3><p>1. The buyer (ticket holder) as a&nbsp;visitor to the Event must undergo a&nbsp;security check upon entry to the Event.<br>2. It is forbidden to bring, specifically:<\/p><ul><li>weapons and dangerous objects,<\/li><li>glass containers, cans, pyrotechnics, flammable materials,<\/li><li>alcohol and\/or narcotics and psychotropic substances, poisons and precursors,<\/li><li>professional photo\/video equipment (unless the organizer specifies otherwise),  <\/li><li>other items that will be directly defined by the seller based on the nature of the Event.<\/li><\/ul><p>3. The organizer may refuse entry to a&nbsp;person who:<\/p><ul><li>is demonstrably under the influence of alcohol or drugs (narcotics and psychotropic substances, poisons and precursors),<\/li><li>behaves violently and aggressively,<\/li><li>refuses to undergo a&nbsp;security check.<\/li><\/ul><p>4. Expulsion from the Event does not entitle the buyer (ticket holder) as a&nbsp;visitor to a&nbsp;refund of the admission fee.<\/p><h3 style=\"text-align: center;\">11. Prohibition of Recording and Photography with Professional Photo\/Video Equipment<\/h3><p>1. Without the organizer&#8217;s consent, it is forbidden to make audio, visual, or audiovisual recordings with professional photo\/video equipment for marketing or promotional purposes.<br>2. Violation of this prohibition may lead to expulsion from the Event and confiscation of illegally made recordings.<br>3. This prohibition does not apply to Event visitors who make photo\/video recordings for their own personal use.<\/p><h3 style=\"text-align: center;\">12. Rules for VIP Zones<\/h3><p>1. A&nbsp;VIP ticket entitles the holder to entry to the VIP zone to the extent specified for the particular Event.<br>2. The organizer may adjust the scope of VIP services for security or organizational reasons.<br>3. A&nbsp;change in the scope of VIP services does not entitle the holder to a&nbsp;refund of the admission fee if reasonable compensation is provided.<\/p><h3 style=\"text-align: center;\">13. Prohibition of Entry with Animals<\/h3><p>1. It is forbidden to bring animals to the Event, with the exception of: 2. assistance dogs according to special regulations, 3. guide dogs for persons with disabilities.<\/p><ul><li>assistance dogs according to specific regulations,<\/li><li>guide dogs for people with disabilities.<\/li><\/ul><p>2. The organizer is entitled to request proof of the status of an assistance and\/or guide dog.<\/p><h3 style=\"text-align: center;\">14. Rules for Children<\/h3><p>1. The organizer may specify a&nbsp;minimum age for visitors for a&nbsp;particular Event.<br>2. Children under 15 years of age may enter the Event only when accompanied by an adult.<br>3. The organizer is not responsible for supervising minors.<\/p><h3 style=\"text-align: center;\">15. Rules for Persons with Disabilities<\/h3><p>1. The organizer strives to ensure the accessibility of the Event for persons with disabilities to the maximum possible extent, considering the nature and location of the Event.<br>2. The number of places for wheelchair users may be limited by capacity or technical reasons.<br>3. Persons with disabilities must inform the organizer of their needs in advance if necessary to ensure a&nbsp;suitable place.<\/p><h3 style=\"text-align: center;\">16. Taking Photographs and Video Recordings by the Organizer<\/h3><p>1. The organizer may take photographs and video recordings during the Event for promotional purposes.<br>2. By entering the Event, the visitor grants consent to be captured in recordings.<br>3. The visitor may subsequently request the organizer to anonymize their image if they are clearly identifiable in the recording, by sending a&nbsp;request to the email: <a href=\"mailto:info@kupaliskodiakovce.sk\">info@kupaliskodiakovce.sk<\/a>.<\/p><h3 style=\"text-align: center;\">17. Force Majeure<\/h3><p>1. The organizer is not responsible for changes or cancellation of the Event caused by circumstances of force majeure.<br>2. In the event of force majeure, the organizer reserves the right to postpone, change, or cancel the Event.<\/p><h3 style=\"text-align: center;\">18. Personal Data Protection<\/h3><p>1. The seller processes the buyer&#8217;s personal data for the purpose of fulfilling the contract to the extent of: name, surname, email, phone, address, order details, account number for admission fee refunds.<br>2. Purposes of processing:<\/p><p>a. ticket delivery and notification of changes,<br>b. buyer identification for complaints,<br>c. sales statistics (in anonymized form),<br>d. sending commercial communications (option to unsubscribe).    <\/p><p>3. Personal data is stored for a&nbsp;maximum of 12 months, unless a&nbsp;special regulation stipulates a&nbsp;longer period.<br>4. The buyer may request the deletion of their data by sending a&nbsp;request to <a href=\"mailto:info@kupaliskodiakovce.sk\">info@kupaliskodiakovce.sk<\/a>.<br>5. The organizer, as the operator of the website <a href=\"https:\/\/www.kupaliskodiakovce.sk\/\">www.kupaliskodiakovce.sk<\/a>, processes personal data of individuals \u2013 website users\/those interested in the Event and\/or ticket buyers (hereinafter referred to as &#8220;data subjects&#8221;) as a&nbsp;controller in the sense of Article 4, par. 7&nbsp;of the GDPR Regulation.<br>6. In order for an interested party to use the seller&#8217;s services, i.e., to purchase a&nbsp;ticket for the Event through the website <a href=\"https:\/\/www.kupaliskodiakovce.sk\/\">www.kupaliskodiakovce.sk<\/a>, including related actions (ticket delivery, complaint handling, admission fee refund, etc.), they must provide their personal data to the seller, to the extent specified in the point above. Without providing this personal data, the seller cannot provide services to the interested party\/ticket buyer for the Event.  <\/p><h3 style=\"text-align: center;\">19. Final Provisions<\/h3><p>1. The invalidity of any provision does not affect the validity of the other provisions of the T<br>2. The seller is entitled to change the T at any time. The new wording is effective from the date of publication on the website.<br>3.
